Online Supplement Volume 93
Notre Dame Law Review Online Supplement published its first piece of Volume 93: “Dead Precedents.” This piece is the first in a series of essays the Online Supplement will publish on a rolling basis over the course of the coming academic year. Our first piece was written by Volume 93’s Executive Editor, Riley T. Svikhart. “Dead Precedents” explores the Supreme Court’s reluctance to overrule its past decisions, gives an account for this phenomenon, and examines the link between the Roberts Court’s treatment of dying precedents and its affinity for the constitutional avoidance doctrine.
